Privacy Policy

Digit Technologies Inc. (“Digit” or “Company”) takes Your privacy rights seriously. This Privacy Policy describes Digit’s policies and procedures on the collection, use and disclosure of Your information when You use the Service.

Applicability of the Policy

This Privacy Policy applies to https://www.digit-software.com/ (“Website”) and services owned and operated by Digit, including the cloud application run as Software as a Service (SaaS) available on https://app.digit-software.com/ (“Service”). The Service also includes customer-facing portals, an application programming interface (API) and webhooks, and optional artificial intelligence features, each as described below. By using or accessing the Website or Service in any manner, You acknowledge that You accept the practices outlined in this Privacy Policy and You hereby consent that We will collect, use, and share Your information as outlined in this Privacy Policy.

This Privacy Policy does not apply to any third-party applications or software that integrate with Services or any other third-party products, services, or businesses.

If You use the Website and Service as part of an entity or organization that has a corporate account with Digit, like Your employer (“Client”), that Client may have entered into a separate agreement with Digit (“Client Agreement”), which may contain more restrictive terms than what is described in this Privacy Policy.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Services or parts of our Service.
  • Aggregate Data means de-identified information, learnings, logs, and data We collect about a group or category of services or users.
  • AI Features means the optional, add-on artificial intelligence capabilities of the Service, including document data extraction (for example optical character recognition of uploaded files), the in-product onboarding assistant, and connectivity that allows a Client to connect a third-party AI provider to the Service. AI Features are not enabled for every account and are used at the Client’s election.
  • Business for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of the processing of Consumers’ personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ personal information, that does business in the State of California.
  • Client End User means a customer, contact, or other third party of a Client whose information a Client submits to or makes accessible through the Service, including through a customer-facing portal.
  • Company (referred to as either “the Company”, “Digit”, “We”, “Us” or “Our” in this Agreement) refers to Digit Technologies Inc., 209 Gateway Drive, Rocky Face, GA 30740.
  • Consumer for the purpose of the CCPA (California Consumer Privacy Act), means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
  • Personal Data is any information or set of information that directly or indirectly identifies or could be used by Digit or its agents to identify an individual, such as a name, address, location data, online identifier, one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual, and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules, or regulations. Personal Data does not include Aggregate Data or publicly available information that has not been combined with non-public Personal Data.
  • Sale for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s personal information to another business or a third party for monetary or other valuable consideration.
  • Service refers to Digit’s cloud inventory and manufacturing software, including the Website, the SaaS application, customer-facing portals, the API and webhooks, and the optional AI Features.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to Digit, accessible from https://www.digit-software.com/
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Under GDPR (General Data Protection Regulation), You can be referred to as the Data Subject or as the User as you are the individual using the Service.

Collecting and Using Your Personal Data

Types of Data Collected

Information Collected When You Sign Up and Use Digit’s Service

While using Our Service, We may ask You to provide Us with certain Personal Data that can be used to contact or identify You. Personal Data may include, but is not limited to:

  • Email address
  • First name and last name
  • Login information, such as user name and password
  • Phone number
  • Address, State, Province, ZIP/Postal code, City
  • Payment and billing information, such as credit card number
  • Usage Data
  • Data submitted by You to customer support

Information Collected From our Website

  • Information Provided by You. As You engage with the Website You may choose to share Personal Data, such as Your first and last name, job title, email address, mailing address, phone number, and company name.
  • Usage Data (as described in the next paragraph)
  • Cookies and Tracking Technologies (as described below)

Data You and Your Client Submit to the Service

When You use the Service as part of a Client account, the Client controls the data entered into the Service. That data may include Personal Data about the Client’s own employees, contacts, suppliers, and Client End Users (for example, information made accessible through a customer-facing portal). Digit processes this data on the Client’s behalf and in accordance with the Client Agreement and our Data Processing Addendum. If You are a Client End User and have questions about how Your information is handled, please contact the Client that provided Your information to Digit.

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. We deploy these through Google Tag Manager. The technologies We use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on Your Device. A persistent cookie remains on your device after you close your browser so that it can be used by your browser on subsequent visits to our Platform. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser.
  • Web Beacons. Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics.

Marketing Tools and Visitor Tracking

We use the following additional tools on our Website for marketing and lead generation purposes:

  • Google Tag Manager. We use Google Tag Manager to deploy and manage analytics and marketing scripts on our Website. Google Tag Manager itself does not collect Personal Data, but it loads the third-party tools described in this section and in the cookie table above.
  • Hobbes (hihobbes.com). We use Hobbes, an AI-powered interactive demo tool, on our Website. When You interact with a Hobbes demo, Hobbes may collect information about that interaction (such as questions asked, pages visited, and session behavior) and share that information with Digit and, where applicable, sync it to our CRM (HubSpot) and marketing automation tools. If You interact with a Hobbes demo and provide contact information, that information may be used by Digit to follow up. Hobbes operates subject to its own privacy policy at hihobbes.com.

Information Collected When You Apply to Our Job Postings

  • Contact Information. We collect personal identifiers and contact information from You, such as Your first name, last name, mailing address, email address, and phone number.
  • Employment History and References. We collect information about Your current and previous employment information, such as Your job title, name of the employer, and employment history. You may also be asked to provide professional references.
  • Protected Classifications Under State and Federal Law. As part of Your employment application, We may also collect data regarding Your gender, veteran status, race, and disability status. The provision of this data by You is optional.

No Sensitive Data

Digit does not generally collect sensitive Personal Data, which includes Personal Data such as racial or ethnic origins, religious, political, or philosophical beliefs, health or medical information, genetic or biometric data, bank account information (except when required to process your purchases), or other sensitive Personal Data as defined by applicable law. Digit will obtain Your consent should We need to collect Your sensitive Personal Data. Where a Client chooses to submit such information to the Service as part of its own business records, Digit processes that information on the Client’s behalf and subject to the Client Agreement and our Data Processing Addendum.

AI Features

The Service offers optional, add-on AI Features that are not enabled for every account and are used at the Client’s election. When a Client uses AI Features, Personal Data may be processed as follows:

  • Internal AI processing. Digit uses third-party AI providers as service providers to deliver certain features, such as document data extraction (for example optical character recognition of uploaded files and PDFs) and an in-product onboarding assistant. Content submitted to these features may be transmitted to those providers solely to return a result to the Client. Digit does not permit these providers to use Client content to train their publicly available models.
  • Customer-connected AI providers. A Client may optionally connect a third-party AI tool, agent, or assistant (for example Claude, ChatGPT, or Microsoft Copilot) to the Service using the Client’s own credentials, including through the Model Context Protocol (MCP). Where a Client does so, the connected provider acts at the Client’s direction and under the Client’s own agreement with that provider. The connection uses the same authentication and permission controls that apply to the Client’s access through the Digit interface and API. Digit is not responsible for how such a provider processes data once the Client directs data to it.

Customer Portals, Open API, and Webhooks

  • Customer-facing portals. A Client may use the Service to provide a portal to its own customers (Client End Users). Information about Client End Users that flows through such a portal is controlled by the Client and processed by Digit on the Client’s behalf under the Client Agreement.
  • Open API and webhooks. The Service offers an API and webhooks as optional paid add-ons that allow a Client to read data from, and send data to, other systems the Client chooses. When a Client enables these, data moves to or from those other systems at the Client’s direction and subject to the Client’s own agreements with the operators of those systems.

Call Recording and Transcription

When You attend a meeting or call with Digit (for example a sales, onboarding, or support call), the call may be recorded and transcribed using third-party meeting intelligence tools so that We can capture accurate notes, follow up effectively, and improve our Service. Where required by applicable law, We will provide notice and obtain consent at the start of the call. If You do not wish to be recorded, please let the Digit team member know at the start of the call.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.
  • To manage Your Account: to manage Your registration as a user of the Service.
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication regarding updates or informative communications related to the functionalities, products or contracted services, including security updates.
  • To provide You: news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
  • To manage Your requests: To attend and manage Your requests to Us.
  • To provide AI Features: where a Client elects to use AI Features, to process the relevant content and return results as described in the AI Features section above.
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets.
  • For assessing your candidacy for employment: We may use your Personal Data when we review your application for employment at Digit.
  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

We may share Your personal information in the following situations:

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You, to provide AI Features (including third-party AI providers), to record and transcribe calls and meetings, to operate in-product support chat (Intercom), and to run website analytics and lead generation tools (including Hobbes and Google Tag Manager).
  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy.
  • With business partners: We may share Your contact information (such as name, email address, and company name) with Our business partners to offer You certain products, services or promotions that may be of interest to You. We do not share Customer Data or operational data submitted to the Service with business partners.
  • At the Client’s direction: where You use the Service through a Client account, We share and transfer data as directed by the Client, including through portals, the API, webhooks, and third-party AI providers the Client enables.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Data Security

Digit uses industry standard security measures to protect against the loss, misuse and alteration of the Personal Data under Our control. Although We make good faith efforts to store the Personal Data collected by Us in a secure operating environment that is not available to the public, Digit cannot guarantee complete security. Further, while We take reasonable steps to ensure the integrity and security of our network and systems, We cannot guarantee that our security measures will prevent third-party “hackers” from obtaining this information.

Transfer of Your Personal Data

To facilitate Our operations, We may transfer, store and process Your Personal Data in jurisdictions other than where You live, including in the United States. Laws in these countries may differ from the laws applicable to Your country of residence.

Standard Contractual Clauses. Digit offers Standard Contractual Clauses, also known as E.U. Model Clauses, to meet the adequacy and security requirements for Our Clients that operate in the E.U. and other international transfers of Personal Data. To receive a copy of our standard Data Processing Addendum, incorporating Standard Contractual Clauses, please email help@digit-software.com. In addition, Digit has executed Standard Contractual Clauses with its sub-processors who process Personal Data on behalf of Digit.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.

Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other Legal Requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public
  • Protect against legal liability

GDPR Compliance

Legal Basis for Processing Personal Data under GDPR

We may process Personal Data under the following conditions:

  • Consent: You have given Your consent for processing Personal Data for one or more specific purposes.
  • Performance of a contract: Provision of Personal Data is necessary for the performance of an agreement with You and/or for any pre-contractual obligations thereof.
  • Legal obligations: Processing Personal Data is necessary for compliance with a legal obligation to which the Company is subject.
  • Vital interests: Processing Personal Data is necessary in order to protect Your vital interests or of another natural person. This basis applies in emergency situations, for example where processing is necessary to protect life.
  • Public interests: Processing Personal Data is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Company. This basis is included for completeness; Digit does not currently process data on this basis.
  • Legitimate interests: Processing Personal Data is necessary for the purposes of the legitimate interests pursued by the Company.

Your Rights under the GDPR

If You are a resident of the European Union, United Kingdom, Lichtenstein, Switzerland, Iceland, or Norway, You have the data subject rights under the GDPR as described below. Please note that We may process Personal Data of our Clients’ end users or employees in connection with our provision of Service, in which case We may not be able to respond to Your request. As such, please contact the data controller (Your employer) to address your rights with respect to such data.

  • Request access to Your Personal Data. The right to access, update or delete the information We have on You.
  • Request correction of the Personal Data that We hold about You. You have the right to have any incomplete or inaccurate information We hold about You corrected.
  • Object to processing of Your Personal Data. This right exists where We are relying on a legitimate interest as the legal basis for Our processing and there is something about Your particular situation, which makes You want to object to our processing of Your Personal Data on this ground. You also have the right to object where We are processing Your Personal Data for direct marketing purposes.
  • Request erasure of Your Personal Data. You have the right to ask Us to delete or remove Personal Data when there is no good reason for Us to continue processing it.
  • Request the transfer of Your Personal Data. We will provide to You, or to a third-party You have chosen, Your Personal Data in a structured, commonly used, machine-readable format.
  • Withdraw Your consent. You have the right to withdraw Your consent on using your Personal Data. If You withdraw Your consent, We may not be able to provide You with access to certain specific functionalities of the Service.

Exercising of Your GDPR Data Protection Rights

You may exercise Your rights of access, rectification, cancellation and opposition by contacting Us. Please note that we may ask You to verify Your identity before responding to such requests. If You make a request, We will try our best to respond to You as soon as possible.

You have the right to complain to a Data Protection Authority about Our collection and use of Your Personal Data. For more information, if You are in the European Economic Area (EEA), please contact Your local data protection authority in the EEA.
